1. Information We Automatically Collect

We automatically collect certain information to help us understand how our users use the Sites (which we will refer to in this Privacy Policy collectively as "Usage Data"). 2. Information You Choose To Submit

You can visit the Sites without telling us who you are or revealing any information by which someone could personally identify you (which we will refer to in this Privacy Policy collectively as "Personal Information"). If, however, you wish to register to become a member of the Sites, you are required to provide certain Personal Information (e.g., your name and e-mail address), and we ask that you also provide a user name and password. We use your Personal Information to fulfill your requests for products and services, to improve our services, and to contact you from time to time about us, our Sites, and our products and services. You may also choose to submit additional information about yourself (for example your gender, birth date, or zip code) by which someone could not personally identify you (which we will refer to in this Privacy Policy collectively as "Non-Personal Information"). 3. Our Information Sharing Practices

Except as otherwise described in this section of our Privacy Policy, we will never share your Usage Data, Personal Information, Non-Personal Information, or Shared Information (which we will refer to in this Privacy Policy collectively as "User Information") with any third party without your permission.

(b) Advertisers. From time to time, we may share your Usage Data and Non-Personal Information to enable third parties who serve advertisements on the Sites to deliver advertisements that will be relevant to you. We will not share any such information, however, in a manner that would enable the advertiser to personally identify you.

(c) Aggregated Data. From time to time, we may share aggregated User Information with third parties. We will not share any aggregated data, however, in manner that would enable the recipient to personally identify you.

Notwithstanding anything in this Privacy Policy to the contrary, we reserve the right, and you hereby expressly authorize us, to share any User Information: (1) in response to subpoenas, court orders, or legal process, or to establish, protect, or exercise our legal rights or defend against legal claims; (2) if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the safety of any person or property; (3) if we believe it is necessary to investigate, prevent, or take action regarding significant abuse of the Sites' infrastructure or the Internet in general (such as voluminous spamming, denial of service attacks, or attempts to compromise the security of information); (4) to our parent company, subsidiaries, joint ventures, or other companies under common control with us (in which case we will require such entities to honor this Privacy Policy); and (5) if we are acquired by or merged with another entity.

4. Public Information

If you identify any User Information as public, you are authorizing us to share such information publicly. For example, you may elect to make certain Shared Information (such as your alias, bio, email or photos) publicly available. Also, there may be areas of the Sites (e.g., message boards, discussion rooms, and other online forums) in which you are able to post information that will be available to all other users of the Sites. By choosing to use these areas, you understand and agree that anyone may access, use, and disclose any information that you post to those areas. Unless set to private (viewable only to your Member relationships), your profile may display Information to the general public, including display name, Profile URL, photo, your member relationships.

5. Choice/Opt-Out

We offer you the opportunity to choose not to receive communications from us. If you would like to take advantage of this opportunity, please let us know by accessing and updating your profile. Please note that sometimes these requests may take up to ten business days to process and that we are not responsible for removing information about you from the database of any third party to whom we were authorized to disclose your User Information prior to processing your request. Even if you do take advantage of this opportunity, we reserve the right to send you administrative messages relating to the Sites (e.g., about changes to this Privacy Policy) and to contact you regarding any goods or services you have ordered.

6. Modifying and Deleting Your Personal Information

If you would like to modify or delete from our database any User Information you previously submitted to us, please let us know by accessing and updating your profile. Please note that any User Information that we have copied may remain in back-up storage for some period of time after your request, and that if you delete certain information you may not be able to order services in the future without re-submitting such information. Also, please note that we will maintain User Information in our database whenever we are required to do so by law.

7. Security

We have implemented reasonable measures to help protect your User Information from loss, misuse, or unauthorized access or disclosure. Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your User Information, we cannot guarantee its security.

8. Links

The Sites may contain links to other websites. We are not responsible for the privacy practices of any such other website and urge you to review such practices prior to submitting any information to such websites.

9. Children's Privacy

We are committed to protecting the privacy needs of children and we encourage parents and guardians to take an active role in their children's online activities and interests. The Sites are not intended for and may not be used by children under the age of 13. We do not knowingly collect information from children under the age of 13 and we do not target the Sites to children under the age of 13.

10. Your California Privacy Rights

If you are a resident of the State of California, we provide you with information on how to exercise your disclosure choice options such as your right to opt-out (which we may sometimes refer to as "unsubscribe") or opt-in for use of your Personal Information by third parties (such as Advertisers) for marketing purposes. Therefore, pursuant to the California Civil Code, we are not required to maintain or disclose a list of the third parties that received your Personal Information for marketing purposes during the preceding year.

All requests must be labeled "Your California Privacy Rights" on the e-mail subject line or envelope or post card. For all requests, please clearly state that the request is related to "Your California Privacy Rights", include your name, street address, city, state, zip code and e-mail address (your street address is optional if you wish to receive a response to your request via e-mail) and indicate your preference on how our response to your request should be sent (e-mail or postal mail). We will not accept requests via the telephone or by fax. We are not responsible for notices that are not labeled or sent properly, or do not have complete information.

11. Changes

We may update this Privacy Policy from time to time. If under any such update we make any material change to the way in which we treat your User Information, we will inform you of such change via email or by posting a notice on relevant areas of the Sites. Any updated version of this Privacy Policy will be effective as of the date set forth therein.

This agreement contains the terms of service and conditions governing this website www.freelineskates.com. (the "Site") By using any of this Site, you expressly accept and agree to abide by all the terms and conditions contained in this Legal Statement. (the "Agreement") Do not use any Sites if you do not accept and agree to these terms and conditions. The Site is available only for your personal use, which shall be limited to viewing the Site, providing information to the Site, downloading product information for your personal review, and the purchase of products.

ELIGIBILITY

The Site and the community features are offered and made available only to users 13 years or older and certain features (including, but not limited to, registration and newsletter signups) may be subject to heightened age and/or other eligibility requirements. If you are between 13 and 17 or under the age of majority where you live, before you use the community features of the Site please review this Agreement with your parents or guardians. Until you reach the age of majority where you live, you certify that your parents or guardians have consented to your use, they have agreed to this Agreement on your behalf, and you agree to provide them with your current registration e-mail address and password at all times. By your use, you certify that you are at least 13 years of age or the required greater age for certain features and meet any other eligibility requirements.

REGISTRATION AND SECURITY

By signing up to purchase products through our Site or participate in the Site's community features, you must register with the Site. Please read our Privacy Policy, which describes how we may use the personally identifiable information ("Personal Information") we collect.

To register with Freeline Sports and access the community features, you must provide a valid e-mail address and password (together, your "User ID"), as well as certain other information. You may provide only true, complete and current information about you. Your User ID gives you access to your Freeline Sports account and the community features that you join. You may not allow anyone else to access or use your Freeline Sports account or User ID. You are responsible for all activities that occur under your Freeline Sports account or User ID. If you are between 13 and 17 or under the age of majority where you live, you must provide your parents or legal guardians with your current User ID at all times. You may not disclose your User ID to anyone else. You agree to immediately notify us if you believe there may be any unauthorized access or use of your Freeline Sports account or User ID, or any other security concern. You may not sell, assign or transfer your Freeline Sports account or User ID.

If you opt in to connect your Freeline account and data with Facebook (through the Facebook Connect feature- both Facebook and Facebook Connect being registered trademarks of Facebook) or with any other third party networking (or other) site, that data may become public through the other site.

USE OF INFORMATION SUBMITTED BY YOU

Note: This section does not apply to personal data supplied by you to any Site, such as your name, address, e-mail address, telephone number and the like. Please see our Privacy Policy Statement for information regarding our treatment of personal data.

Freeline does not claim ownership of any information, data, text, software, music, sound, photographs, graphics, video, messages, tags or other materials you submit for display or distribution to others through the Site (collectively, "User Submissions"). As between Freeline Sports and you, you own all rights to your User Submissions. However, you grant to Freeline Sports and our affiliates, representatives, and assigns an irrevocable, perpetual, non-exclusive, fully-paid, world-wide, license (sublicensable through multiple tiers) to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform, and publicly display your User Submissions (in whole or in part) in any format or medium now known or later developed; provided, however, that the exercise by Freeline Sports of its rights under the foregoing license shall at all times be subject to the limitations upon disclosure of your User Submissions imposed upon Freeline Sports under the Privacy Policy. Freeline Sports reserves the right to display advertisements in connection with User Submissions and to use User Submissions for advertising and promotional purposes. Freeline Sports will be free to use any ideas, concepts, know-how or techniques contained in User Submissions for any purpose whatsoever, including but not limited to developing, manufacturing and marketing products which incorporate or otherwise rely upon such information. Freeline Sports welcomes your comments and suggestions on its Site and products, but Freeline Sports does not seek to solicit any confidential or proprietary ideas, suggestions, materials or other information relating to developing, designing, redesigning, modifying, manufacturing or marketing its products or any new products. By submitting information, you warrant that Freeline Sports may publish such information, use it as part of its operations, and incorporate its concepts in Freeline Sports products without liability.

Freeline does not pre-screen User Submissions and you agree that you are solely responsible for all of your User Submissions. Freeline is not required to host, display, or distribute any User Submissions, and may remove at any time or refuse any User Submissions. Freeline is not responsible for any loss, theft or damage of any kind to any User Submissions. You represent and warrant that your User Submissions and Freeline's authorized use thereof do not and will not infringe the rights of any third party (including, without limitation, intellectual property rights, rights of privacy or publicity, or any other legal or moral rights).

PROPRIETARY RIGHTS OF FREELINE; LIMITED LICENSE

Freeline Sports and this Site, including, but not limited to, software, applications, databases, information, organization, text, graphics, look and feel, advertising copy and other intellectual property, are the proprietary property of us or our licensors, with all rights reserved. Provided that you meet our eligibility requirements and comply with this Agreement, we grant you a limited license to access and use the Site. This limited license is non-exclusive, for your personal non-commercial use only, non-sublicensable, non-transferable and revocable at any time without notice for any reason. Except as expressly granted in this Agreement, you may not upload, download, display, distribute, copy, modify, create derivative works from, store, sell, transfer or use the Site, or allow others to do so without our express consent. You must abide by, and not remove or interfere with, any proprietary notices, information or restrictions on the Site or content available therein (other than your own User Content). Unless expressly stated herein, nothing in this Agreement may be construed as granting any license to intellectual property rights. Nothing in this Agreement may be construed as granting any rights of ownership in the Site. Freeline is protected under United States federal and state laws and regulations, as well as applicable foreign laws, regulations and treaties, and any unauthorized use may subject you to civil liability, criminal prosecution or both.

FREELINE, FREELINE SPORTS and other Freeline logos, designs, graphics, icons and service names are registered marks, marks or trade dress of Freeline in the United States and/or other countries, and may not be used without the express consent of Freeline.

COMMUNITY RULES OF CONDUCT

You agree not to use, or knowingly condone others using, Freeline and the community features:

to transmit, upload or make available User Content or other material that is defamatory, hateful, pornographic, obscene, menacing, offensive or harmful, that could cause undue annoyance, inconvenience or anxiety to anyone else, or that otherwise violates this Agreement;
as a means to threaten, stalk, harass, bully, abuse, exploit, insult or otherwise harm anyone else;
in a way that violates or infringes the rights of anyone else, including, for example, other people's copyright or right to privacy;
to transmit, upload or make available unsolicited or unauthorized advertising or promotional materials, for example, junk mail, "spam," chain letters, pyramid schemes or similar materials;
to disclose Personal Information of you or anyone else, including, for example, on a Member profile or Community Site;
to collect Personal Information about other Members or users, including, for example, by spamming or phishing;
to create a false identity that misleads others about the sender or origin of a message, for example, you must not impersonate anyone else;
to transmit, upload or make available any material that would amount to a breach of this Agreement if you had posted it directly, or that contains any virus or other harmful file or program, or that may otherwise harm our online services or our computer systems or any third-party computer system;
in any way that could cause our or another user's services, hardware or networks to be interrupted, damaged or rendered less efficient;
to cover, obscure or interfere with any advertisement on Freeline or Freeline Community;
by any unauthorized means;
for any unlawful purpose; or
in any other way that violates this Agreement or that could reasonably be expected to affect us adversely or reflect negatively on our goodwill, name or reputation.

If you become aware of misconduct on Freeline Sports Site (for example, cyberbullying, harassment or other improper or criminal activity), please report it to us by accessing the "More" or "My Pages" dropdown menu and selecting "Report Abuse". "Report Abuse" is also available by clicking the "Flag" icon associated with a Member profile or User Content. You may also contact us at info@freelineskates.com.

You are solely responsible for your use, including, but not limited to, all conduct that occurs in your Freeline account or under your User ID. The information and materials on Freeline and Freeline Community are provided solely for your personal and private use and must not be used for any business or commercial purpose without our express consent. For example, you may not copy, transmit or reverse-engineer anything available on Freeline or Freeline Community, or use framing techniques to enclose any part of Freeline or Freeline Community, without our express consent. Unless we specifically indicate otherwise, you also may not modify information or materials available on Freeline or Freeline Community by making a "mash-up", derivative work or otherwise. Your use of Freeline and Freeline Community is subject to all applicable laws, regulations and treaties.

CONTESTS AND PROMOTIONS

From time to time, Freeline Sports or our licensees, suppliers or Advertisers may conduct promotions on or through Freeline and the community, including, but not limited to contests ("Promotions"). Each Promotion may have Additional Terms, which will be posted or otherwise made available to you, and for purposes of each Promotion, will be deemed incorporated into this Agreement. It is your responsibility to read and abide by the Additional Terms.

THIRD-PARTY SITES

Freeline Sports is not responsible for links to third-party sites ("Outside Sites") that are made available, or that you use, on or in connection with Freeline or its community features. We do not verify, endorse or have any responsibility for Outside Sites, their business or privacy practices, or any associated goods or services. If an Outside Site obtains or collects Personal Information from you, we are not responsible. Therefore, always use your own best judgment when dealing with an Outside Site.

PRODUCT AND PRICING INFORMATION

Although Freeline Sports has made every effort to display the products and their colors as accurately as possible, the displayed colors of the products will depend upon the monitor of the user and Freeline Sports cannot guarantee that the user's monitor will accurately portray the actual colors of the products. Products displayed may be out-of-stock or discontinued, and prices are subject to change. Freeline Sports is not responsible for typographical errors regarding price or any other matter. Subject to the foregoing, the prices displayed are quoted in U.S. dollars and are effective only for United States purchases. Freeline is established in the State of California in the United States, meaning that you are accessing a community network in the U.S. Freeline is governed by and operated in accordance with the laws of the U.S. By using Freeline or participating as a Member of the Freeline Community and/or providing us with your Personal Information or other information, you (a) consent to the transfer, processing and/or storage of any Personal Information and other information you provide to Freeline and/or the Freeline Community, (b) acknowledge that U.S. law provides a lower standard of protection for personal data than the laws of various countries including, but not limited to, the European Union and (c) understand that Freeline and Freeline Sites will collect, transfer to, process and/or store and deal with your Personal Information and other information in accordance with our Privacy Policy and U.S. law. Consequently, you waive any claims that may arise under the laws and regulations that apply to you in or of any other country or jurisdiction.

CHANGES

Freeline Sports may at any time revise the terms and conditions contained in this Legal Statement by updating this posting. You are bound by any revisions and should periodically visit this page to review the current terms and conditions which apply to your use of the Site. The invalidity of any term, condition or provision of this Legal Statement shall not affect the enforceability of those portions of the Legal Statement deemed enforceable by applicable courts of law.

Freeline Sports reserves the right to withdraw access to the Sites or to revise the services and products described in the Site at any time without notice. You understand and agree that Freeline Sports will determine your compliance with this Agreement in our sole discretion. We reserve the right to deny access to any features of the Site in our sole discretion, at any time, without notice or responsibility to you or anyone. Any violation of this Agreement may be referred to law enforcement authorities.
